International Extradition
International extradition is a legal process by which one country may seek from another country the surrender of a person who is wanted for prosecution, or to serve a sentence following conviction, for a criminal offense. In the United States, international extradition is generally treaty-based, meaning that the United States must have an extradition treaty with the requesting country in order to consider the request for extradition. However, some countries grant extradition without a treaty, and of those that do, most require an offer of reciprocity. Further, U.S. law permits the United States to extradite, without regard to the existence of a treaty, persons (other than citizens, nationals, or permanent residents of the United States) who have committed crimes of violence against nationals of the United States in foreign countries. International Crimes
The most serious crimes of international concern normally refer to violations of the laws of war, crimes against humanity, genocide, and aggression as defined by the Rome Statute which created the International Criminal Court. The International Criminal Court is a relatively new court, and it is far from the only forum where international crimes can be tried. In fact, most war crimes trials have occurred before ad hoc tribunals established by the United Nations or by national courts. The United Nations Security Council has set up a number of ad hoc tribunals like the International Criminal Tribunal for the Former Yugoslavia of the International Criminal Tribunal for Rwanda.
